Compensation for destroyed housing: how and who can get it?

The daily massive rocket attacks and Shahed-136 drone attacks on Ukraine's civilian infrastructure by the terrorist country have left a significant number of our fellow citizens homeless. Since February 24, the total number of messages about damaged real estate in the Diia app has reached almost 300 thousand. In this article we will tell you how the mechanism of receiving compensation for the property destroyed as a result of the hostilities works and how you can submit the corresponding application.
Who can get the money and for what?
Even at the beginning of the full-scale war, Volodymyr Zelenskyy made an important decision on compensation for all destroyed housing and issued a decree on the creation of special commissions to assess the damage. Already in April, the Verkhovna Rada of Ukraine was working on the bill № 7198. Very soon, it will be supplemented and will pass the second reading. Meanwhile, Ukrainians already have the opportunity to fill out a form to receive funds through the Diia app.
Not only destroyed apartments, cottages, garden buildings and private houses, but also partially destroyed residential premises are specified as damages for which payment from the state is provided. In addition, the owners of objects of unfinished construction, where support frames have already been erected, can expect to receive funds.
As for those who can claim compensation, these are the citizens of Ukraine who have the right to the damaged real estate, as well as the heirs of these people.
The distribution of funds will take place gradually. Thus, in each community, the owners of damaged housing will have their place in the general queue. The following categories of citizens are prioritized for receiving funds:
- participants of military operations;
- large families;
- people with disabilities.
The applications for compensation for damages can be submitted not only during the martial law, but also a year after it. In addition, destructions that occurred as a result of the demining of territories are also covered by the new law.
The form of compensation
First of all, after a person submits an application for housing damage, it must be checked by the local social services. If they determine that the area of damage is insignificant, the restoration will be carried out by the city authorities with funds from the Reserve Fund, created for such cases.
A housing certificate is provided for the owners of completely destroyed buildings. This is a document that exists in electronic form and gives a citizen the right to purchase new housing anywhere in the country, with the exception of the occupied territories and those where active hostilities are taking place. Interestingly, a person can invest in a more expensive project and cover the difference at his own expense, or combine several certificates from different owners and purchase one residential property.
Scheme for calculating of compensation
The above-mentioned bill has a simple scheme for calculating the amount of monetary compensation: the value of one square meter is multiplied by the area of the destroyed home. Each individual object has its own estimated cost per square meter.
For now, it is impossible to say about specific amounts, because the law has not yet been finalized. For example, Borys Filatov, the mayor of Dnipro, stated that the city will allocate up to 500 thousand hryvnias per house to cover damages.
How to get payments?
To get on the Register of Damaged Property and get your place in the queue for compensation, follow this algorithm:
- Submit an application. To do this, you can use the Diia app online or visit your local Administrative Service Centers (ASC) or notary in person.
- Wait for the property survey commission. It's up to them to draw up a damage report, which will be the basis for the compensation.
- Get compensation/reimbursement. You should distinguish these two terms, because the first involves receiving funds from frozen Russian assets or future reparations, while the second places the responsibility on the local authorities. The waiting period for payments depends on this.
The compensation distribution mechanism should be up and running as early as next year. If you own a damaged or destroyed home, apply to the registry and help others do the same. Our country must get as much evidence of the enemy's destruction of civilian infrastructure as possible in order to bring him to maximum responsibility.
